1. Purpose
These terms govern the use of the iOS app Mon parcours trans (hereinafter "the App"), distributed free of charge on the App Store. By installing or using the App, you accept these terms.
2. Publisher
The App is published by Mourad Zinbi, as a sole individual, in France. Contact: zinbimourad149@gmail.com.
3. Nature of the service
The App is a personal journal that lets you record:
- the hormone treatments you are following,
- your doses and reminders,
- the values of your lab results as you enter or scan them,
- your personal journal entries.
The App does not interpret the values you enter, makes no diagnosis, issues no therapeutic recommendation and emits no clinical alert. It is in no way a substitute for medical follow-up, a prescription, or the advice of a qualified health professional.
Within the meaning of Regulation (EU) 2017/745 on medical devices, the App is not a medical device and is not intended to become one.
4. User responsibility
You alone remain responsible for your therapeutic decisions. Any question relating to your treatment, your lab results or your health must be discussed with your doctor, your endocrinologist or another qualified professional.
You are also responsible for:
- the accuracy of the information you enter,
- the confidentiality of your master password,
- backing up your device: no copy of your data is kept outside your iPhone. Losing or resetting the device results in the permanent loss of your data.
5. Data and privacy
Every piece of data you enter is stored locally, encrypted with your master password. The App performs no network transmission of your health data. For details, see the privacy policy.
6. Intellectual property and code licence
The source code of the App is published under the GNU Affero General Public License v3.0 (AGPL-3.0). The name Mon parcours trans, the logo and the visual identity remain the property of the publisher.
7. Availability and changes
The App is provided "as is", with no guarantee of uninterrupted availability. The publisher may modify, suspend or discontinue all or part of the service at any time, in particular for technical, legal or compliance reasons.
8. Limitation of liability
To the extent permitted by law, the publisher cannot be held liable for indirect damages, data loss resulting from improper use or from failure to back up the device, nor for the consequences of any medical decision made on the sole basis of the information displayed by the App.
Nothing in these terms is intended to exclude the publisher's liability in cases of wilful misconduct, gross negligence, or in any situation where such exclusion is prohibited by applicable law.
9. Intended audience
The App is intended for personal use by people who are of legal age (18 years or older). If you are a minor, you are invited to use the App under the supervision of a legal guardian.
10. Purchases and subscriptions
As of today, the App is free and offers no in-app purchase or subscription. Any change on this point will be announced before taking effect.
11. Changes to these terms
The publisher may modify these terms. The applicable version is the one published at this URL on the date of your use. Material changes are flagged in the App.
12. Governing law and jurisdiction
These terms are governed by French law. Failing an amicable resolution, any dispute shall fall within the jurisdiction of the French courts, subject to the mandatory rules applicable to consumers.
